These Terms of Service (“Terms”) govern your use of montageatrois.com (the “Site”) and your general relationship with Montage à Trois (“Montage à Trois,” “we,” “us”). By using the Site or contacting us to inquire about services, you agree to these Terms.

These Terms cover the Site and our services generally. Two categories of engagement are governed by more specific agreements that take precedence over these Terms wherever they conflict:

  • Production engagements (on-set coordination, choreography consultation, nudity/simulated-sex rider review, and similar services for a specific film, television, or theater production) are governed by a signed Production Services Agreement between Montage à Trois and the production.
  • Workshops and training for individuals or groups are governed by our Workshop & Training Terms, which include registration, cancellation, and liability terms specific to in-person training.

Who Can Use Our Services

Our services are intended for adults working in professional film, television, and theater production, and for adult individuals and groups seeking training. You must be at least 18 years old to submit an inquiry, book a consultation, or register for a workshop. We do not provide services involving minors.

Inquiries and Consultations

Submitting the contact form or booking a consultation is a request for information, not a binding commitment by either party. A production engagement or workshop registration is only binding once confirmed in writing (a signed Production Services Agreement, or a completed workshop registration and payment).

Confidentiality of Production Materials

If you share production materials with us — scripts, casting information, scheduling, or other details about a production in development — before a formal agreement is signed, we will treat that information as confidential: we will not disclose it to third parties outside our team, use it for any purpose other than evaluating or preparing to provide the requested services, or retain it longer than reasonably necessary. This interim protection is superseded by the more detailed confidentiality terms of a signed Production Services Agreement once one is in place.

Deposits, Fees, and Cancellation

Specific pricing, deposit, and cancellation terms are set out in the applicable Production Services Agreement or, for workshops, the Workshop & Training Terms. As a general matter across all engagement types: deposits secure our availability for the dates booked, are applied to the final fee, and become non-refundable as the engagement date approaches on a schedule set out in the specific agreement, to reflect the fact that we turn away other work to hold your dates.

Intellectual Property

The Site’s content — text, design, and branding — belongs to Montage à Trois and may not be copied or reused without permission. This is separate from the ownership of engagement-specific work product (choreography notes, rider language, coordination plans), which is addressed in the applicable Production Services Agreement.

Services like nudity/simulated-sex rider review help align expectations between performers and productions and reflect industry practice (including standards published by SAG-AFTRA and Actors’ Equity Association for intimacy coordination), but they are not a substitute for review by a production’s own legal counsel. We recommend productions have riders and related agreements reviewed by an attorney before execution.

Disclaimers and Limitation of Liability

Our services are provided based on professional judgment and industry-standard practice; we cannot guarantee a particular outcome for any scene, rehearsal, or workshop. To the fullest extent permitted by law, Montage à Trois’s total liability arising out of any engagement is limited to the fees paid for that specific engagement, and we are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law, including for gross negligence or willful misconduct.

Indemnification

You agree to indemnify Montage à Trois against claims arising from your breach of these Terms or misuse of the Site. Mutual indemnification terms specific to a production engagement are set out in the Production Services Agreement.

Force Majeure

Neither party is liable for delay or failure to perform caused by circumstances beyond reasonable control, including production shutdowns, severe weather, or public health emergencies.

Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in Travis County, Texas, and you consent to that venue. We may perform services or hold workshops in other states as engagements require; doing so does not change the governing law or venue set out here, though we’ll separately note in a given engagement or workshop’s paperwork if local law requires something different (for example, a state-specific liability waiver requirement).

Changes to These Terms

We may update these Terms from time to time; the “Last updated” date above reflects the most recent version. Continued use of the Site after changes take effect constitutes acceptance.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
